Purpose and scope\u003c/h2\u003e\n\u003cp\u003eThis\n procedure is designed to help and encourage all club members to achieve\n and maintain standards of conduct. The code of conduct and this \nprocedure apply to all club members. The aim is to ensure consistent and\n fair treatment for all in the organisation.\u003c/p\u003e\n\u003ch2\u003e2. Principles\u003c/h2\u003e\n\u003cp\u003eInformal action will be considered, where appropriate, to resolve problems.\u003c/p\u003e\n\u003cp\u003eNo disciplinary action will be taken against a club member until the case has been fully investigated.\u003c/p\u003e\n\u003cp\u003eFor\n formal action the club member will be advised of the nature of the \ncomplaint against him or her and will be given the opportunity to state \nhis or her case before any decision is made at a disciplinary meeting.\u003c/p\u003e\n\u003cp\u003eClub\n members will be provided, where appropriate, with written copies of \nevidence and relevant witness statements in advance of a disciplinary \nmeeting.\u003c/p\u003e\n\u003cp\u003eAt all stages of the procedure the club member will have \nthe right to be accompanied by a governing body representative, or club \nmember of their choice.\u003c/p\u003e\n\u003cp\u003eNo club member will be removed from the \nclub for a first breach of discipline except in the case of gross \nmisconduct, when the penalty will be removal without notice or refund.\u003c/p\u003e\n\u003cp\u003eA club member will have the right to appeal against any disciplinary action.\u003c/p\u003e\n\u003cp\u003eThe procedure may be implemented at any stage if the club member’s alleged misconduct warrants this.\u003c/p\u003e\n\u003ch2\u003e3. The procedure\u003c/h2\u003e\n\u003ch3\u003eFirst stage of formal procedure\u003c/h3\u003e\n\u003cp\u003eThis will normally be:\u003c/p\u003e\n\u003cul\u003e\u003cli\u003ea\n first warning for misconduct if conduct does not meet acceptable \nstandards. This will be in writing and set out the nature of the \nmisconduct and the change in behaviour required and the right of appeal.\n The warning will also inform the club member that a final written \nwarning may be considered if there is no sustained satisfactory \nimprovement or change. A record of the warning will be kept, but it will\n be disregarded for disciplinary purposes after 6 months.\u003c/li\u003e\u003c/ul\u003e\n\u003ch3\u003eFinal written warning\u003c/h3\u003e\n\u003cp\u003eIf\n the offence is sufficiently serious, or if there is further misconduct \nduring the currency of a prior warning, a final written warning may be \ngiven to the club member. This will give details of the complaint, the \nimprovement required and the timescale. It will also warn that failure \nto improve may lead to removal from the club (or some other action short\n of removal) and will refer to the right of appeal. A copy of this \nwritten warning will be kept by the exec committee but will be \ndisregarded for disciplinary purposes after 12 months subject to \nachieving and sustaining satisfactory conduct.\u003c/p\u003e\n\u003ch3\u003eRemoval or other sanction\u003c/h3\u003e\n\u003cp\u003eIf\n there is still further misconduct, the final step in the procedure may \nbe dismissal or some other action short of dismissal such as demotion or\n disciplinary suspension. Removal decisions can only be taken by the \nexec subcommittee, and the club member will be provided in writing with \nreasons for removal, the date on which their club membership will \nterminate, and the right of appeal.\u003c/p\u003e\n\u003cp\u003eIf some sanction short of \nremoval is imposed, the club member will receive details of the \ncomplaint, will be warned that dismissal could result if there is no \nsatisfactory improvement, and will be advised of the right of appeal. A \ncopy of the written warning will be kept by the supervisor but will be \ndisregarded for disciplinary purposes after 6 months subject to \nachievement and sustainment of satisfactory conduct or performance.\u003c/p\u003e\n\u003ch2\u003eGross misconduct\u003c/h2\u003e\n\u003cp\u003eThe following list provides some examples of offences which are normally regarded as gross misconduct:\u003c/p\u003e\n\u003cul\u003e\u003cli\u003etheft or fraud\u003c/li\u003e\n\n\u003cli\u003ephysical violence or bullying\u003c/li\u003e\n\n\u003cli\u003edeliberate and serious damage to property\u003c/li\u003e\n\n\u003cli\u003eserious misuse of an organisation’s property or name\u003c/li\u003e\n\n\u003cli\u003eserious insubordination\u003c/li\u003e\n\n\u003cli\u003eunlawful discrimination or harassment\u003c/li\u003e\n\n\u003cli\u003ebringing the organisation into serious disrepute\u003c/li\u003e\n\n\u003cli\u003eserious incapability in the club brought on by alcohol or illegal drugs\u003c/li\u003e\n\n\u003cli\u003ecausing loss, damage or injury through serious negligence\u003c/li\u003e\n\n\u003cli\u003ea serious breach of health and safety rules\u003c/li\u003e\n\n\u003cli\u003ea serious breach of confidence.\u003c/li\u003e\u003c/ul\u003e\n\u003cp\u003eIf you are accused of an\n act of gross misconduct, you may be suspended from the club without any\n wrongdoing implied, normally for no more than seven working days, while\n the alleged offence is investigated. \u003c/p\u003e\n\u003cp\u003eIf, on completion of the \ninvestigation and the full disciplinary procedure, the club is satisfied\n that gross misconduct has occurred, the result will normally be summary\n removal from the club without refund of club membership.\u003c/p\u003e\n\u003ch2\u003eAppeals\u003c/h2\u003e\n\u003cp\u003eA\n club member who wishes to appeal against a disciplinary decision must \ndo so within seven working days, in writing, to the Secretary. \u003c/p\u003e\n\u003cp\u003eYou\n have the right to be accompanied by a governing body representative, or\n club member of your choice at this meeting, if you make a reasonable \nrequest.\u003c/p\u003e\n\u003cp\u003eAn exec committee sub-committee of committee members who were not previously involved in the case will hear the appeal.\u003c/p\u003e\n\u003cp\u003eAt the appeal, the sub-committee will review:\u003c/p\u003e\n\u003cul\u003e\u003cli\u003eall information previously presented previously\u003c/li\u003e\n\n\u003cli\u003eany new information made available to them\u003c/li\u003e\n\n\u003cli\u003eany disciplinary penalty imposed.\u003c/li\u003e\u003c/ul\u003e\n\u003cp\u003eAfter the meeting, the sub-committee will give you a decision, normally within 24 hours.
